We have developed this Privacy Policy (this “Policy”) to describe the information we collect, how that information may be used, with whom it may be shared, and your choices, in connection with your use of our website at www.agentio.com, the ad platform we make available, and/or any related services and apps (collectively referred to in this Policy as our “Service”).
By accessing the Service, you agree to be bound by this Policy. If you do not agree to the terms of this Policy, please do not use the Service. Each time you use the Service, the current version of this Policy will apply. Accordingly, when you use the Service, you should check the date of this Policy (which appears at the top) and review any changes since you last reviewed it. Our Service offers brand users (each, a “Brand”) the ability to bid on and purchase an ad unit (“Ad”) to promote and/or endorse its product, service, or brand. The Ad is generally fulfilled by content creators (each, a “Creator”) via Ad reads in videos, but may be fulfilled through other formats as set forth in Agentio’s Terms of Service.
In this Policy, we’ll refer to anything a Brand provides to a Creator in connection with an Ad bid/request, such as the details of a Brand’s ad campaign, text, audio, video, or other materials, as “Brand Submissions,” and the format/means by which a Creator fulfills an Ad as “Creator Content.” The terms “you” or “your” in this Policy will refer generically to any user of our Service, whether a Brand, a Creator, visitor, or otherwise, and specific portions may apply to you as either a Creator or a Brand as indicated below.
We collect two types of information from users of our Service: “personal information,” which is information that that can be used to identify you (such as your name or email address), and “aggregate information,” which is information that cannot be used to identify you (such as frequency of visits to our website and your browser type). We collect personal information and aggregate information in the contexts described below.
As with most apps and websites, when you use our Service we automatically receive and collect information from your device. This information includes the following:
In connection with using the Service, a Creator may authorize Agentio to access and obtain data from the Creator’s YouTube account using application program interfaces provided by Google (the “Google APIs”). Agentio’s use, storage and/or transfer of information received from Google APIs will adhere to the Google API Services User Data Policy (available here), including the Limited Use requirements (if applicable).
Creators will authorize Agentio to access and obtain YouTube data via Google APIs by providing consent through Google’s authorization server, and Creators will receive disclosure from Google with respect to the scope of access being enabled for Agentio and the types of data that will be available to Agentio. Agentio does not receive (and please do not send Agentio) your YouTube log-in credentials in order to retrieve data from your YouTube account.
A Creator’s YouTube data (including Personal Information) may be shared with Brands in connection with a former or active Ad campaign, or it may be shared with Brands the Creator is interested in working with in the future.
If we or a third party service provider have collected your Personal Information in connection with your response to a career opportunity with Agentio, you are giving us permission to use and retain your Personal Information for the purposes of evaluating your application for employment and interacting with you about a specific position that you applied to and/or other roles at Agentio. This Personal Information may be processed and stored by a third party talent tracking solution provider as well as with vendors, consultants, and other service providers who need access to such information to carry out work relating to the recruitment process on our behalf. In connection with such any application, we or our service providers may ask you to provide self-identifying information (such as veteran status, gender, and ethnicity) in conjunction with laws and regulations enforced by the U.S. Equal Employment Opportunity Commission and other regulatory agencies. Providing such self-identifying information is voluntary, but if you do provide such information, we and our service providers may submit that information to the appropriate government or regulatory agencies to fulfill reporting requirements and use that information to defend against employment-related complaints.
Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to help us identify you when you come to our website. You have choices with respect to cookies. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies you may be unable to use those aspects of our website that requires registration in order to participate. Doing so, however, may disable certain features on our website. You can opt-out from third party cookies that are used for advertising purposes on the NAI website at http://www.networkadvertising.
We may use third parties, such as Google Analytics or other analytics providers, to analyze traffic to our website. Google Analytics does not create individual profiles for visitors and only collects aggregate data. We may also use cookies, pixels, beacons, or other web tracking technologies to track the amount of time spent on our Service and whether or not certain content, such as a video was viewed. We may work with a third party to collect and process this information for us, based on our instructions and in compliance with this Policy.
At the present time our Service do not respond to “Do Not Track” signals or similar mechanisms.
In general, we collect information from you so that we can provide our Service, operate our business, and provide information that you request from us. This includes the following uses and purposes:
We do not sell your personal information. Like most companies, we share information in certain circumstances with third parties through operation of our Service and our business. Below we explain when that happens.
We do not currently use third party tools as part of the Service and therefore do not share your Personal Information with third party tools. If we decide to use third party tools with the Service in the future, we will update this Privacy Policy to identify for you what those third party tools are and what information (including Personal Information or data obtained from your YouTube account via Google APIs) is shared with those third party tools, if any. We will provide you the opportunity to opt out of sharing your data with third party tools if you choose.
We may use third party service providers to assist us with operating our business and providing our Service, such as our vendors that help us maintain our Service and partners that assist us with our marketing and communication. These service providers will have access to your information in order to provide services to us. Additionally, our third party payment processors may have access to your information as described in more detail above.
If you have a Creator account, your profile and user information, including but not limited to your demographic information, talent rank, and Your Content are accessible by Brands.
Brands and Creators can also message directly through the Service and Agentio will display your name to other users to facilitate these communications.
Except as otherwise provided in this Policy, we share information with companies, organizations or individuals outside of Agentio only at your direction or when we have your consent to do so.
We may share information with third party companies, organizations, governmental authorities, or individuals outside of Agentio if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:
We may share information about you as part of a merger or acquisition. If Agentio or any of its affiliates is involved in a merger, asset sale, financing, liquidation or bankruptcy, or acquisition of all or some portion of our business to another company, we may share and/or transfer your information with that company before and after the transaction closes without your further consent. In such a case, unless permitted or otherwise directed by applicable law, your information would remain subject to the terms of the applicable privacy policy in effect at the time of such transfer.
While we may share aggregated anonymized conversion data and metrics (e.g., a Creator is in the top 10% at driving conversions) with third parties (including other Creators and Brands), Agentio will not share Brand-specific conversion data with any other Brand or Creator.
We strive to provide you with choices with respect to your information. Also, remember, you can opt not to disclose certain information to us - but keep in mind some information may be needed to create an Agentio account or to use some of our Service and features.
You can access and modify most of your information through the Service. If you would like to modify or access additional information that is not available through the Service, please contact us at support@agentio.com. We may ask you to verify your identify or provide additional information before we act on your request. We may reject or deny requests for certain reasons, such as when we believe a request is fraudulent, or when we are required to retain information for legal or record-keeping reasons.
You can delete most of your information through the Service, and you can delete your account through the Service (specifically, the desktop and mobile-enabled app). You may also request deletion of your account by contacting us at support@agentio.com. Please note that in some cases we may be prohibited from deleting certain information (we will let you know in those situations, and some information may remain in our records after your deletion of such information from your account). We may use any aggregated or de-identified data derived from or incorporating your information after you update or delete it, but not in a manner that would identify you personally.
If you opt-in, or when you use the Service, we may send you newsletters and other messages, including marketing emails, SMS text messages, and other communication about our products and services, and to alert you to relevant advertisements and other opportunities. You may unsubscribe from Agentio marketing communications at any time by following the “unsubscribe” link at the bottom of any such communication.
If you do not wish to continue receiving SMS/MMS mobile messages from us, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from us in order to opt-out. You may receive an additional mobile message confirming your decision to opt-out. If you sign-up to receive text messages from Agentio, you agree to receive recurring automated promotional and personalized marketing text (e.g., SMS and MMS) messages from Agentio, including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number that you designate. Consent to receive automated marketing text messages is not a condition of any purchase. Message and data rates may apply.
We are based in the United States, and our Service is hosted there. If you are using our Service from another country, the laws governing our collection and use of information may be different from the laws of your country. If you decide to use our Service, or share your information with us, you are agreeing to be governed by the laws of the United States, and agree to the transfer of your information to the United States.
Our Service is not directed at children under 13, and we do not knowingly collect information from children under 13. If you are under 13, please do not attempt to use our Service or send any information about yourself to us. If you are the parent of a child under the age of 13, and you believe he or she has shared information with us, please contact us at support@agentio.com so that we can remove such information from our systems.
We use reasonable security measures, including measures designed to protect against unauthorized or unlawful processing and against accidental loss, destruction or damage to your information. We also take certain measures to enhance the security of our Service, however, since the Internet is not a 100% secure environment, we cannot guarantee, ensure, or warrant the security of any information you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information.
Our Service may contain links to other websites and services operated by third parties, and may include social media features such as social media buttons or links. These third-party websites and services may collect information about you if you click on a link or visit those websites or services, and the social media sites may automatically record information about your browsing behavior every time you visit a website that has a social media button. Your interactions with these features and third parties are governed by the privacy policy of the third party, not by this Policy.
We may make changes to this Policy from time to time. When we do, we will post the updated version on this page.
